Nursing Home transition and Diversion Waiver Program
Do you have a parent or other relative in a nursing home but would like to come home and receive Medicaid funded home care services? Or are you trying to keep your loved one from entering into a facility?
The NHTD Program was designed for this purpose. This program enables people to return home with additional services so they can remain there safely.

What is CDPAP?
CDPAP is a Medicaid personal assistance program which gives the consumer more power and control in how they receive their services, who can be their caregiver, and what services they can receive.
Who qualifies for CDPAP?
- Medicaid Long Term Care recipients requiring personal care or nursing care
- Individuals who are “Self-Directing” – meaning you must be able to make safe, smart choices about your care, understand the consequences of your choices and assume responsibility for those choices. Consumers that are not self-directing are permitted to choose another person who may act as their designated representative. That person will make the decisions about your home health care.
What are the Rules of CDPAP?
All consumers and their caregivers (personal assistants or “PAs”) have some New York State generated rules they must follow
- The consumer‘s designated representative CANNOT be the PA
- Spouses and Parents cannot be the PA
- All personal assistants have certain pre-hire and ongoing medical documentation requirements. These include physicals, drug screens, Tuberculosis testing and proof of immunity to Measles and Rubella.
- PAs must be at least 18 years of age.
- PAs must be willing to clock in and clock out using the client’s telephone.
- You must be willing to accept and carry out your responsibilities:
- Finding staff
- Hiring staff
- Training staff
- Supervising staff
- Terminating staff’s employment, if needed
- Acknowledging your responsibilities in writing.

What are the benefits of CDPAP vs. traditional personal care?
- You get your care from a family member, friend or other known person.
- You have greater control and independence over when and how your care gets provided.
- You may have specific language needs which cannot be met from certified aides.
- You may have specific care needs such as skilled nursing care (i.e. injections, medications) which by regulation cannot be provided through the regular personal care program
